Distraint for
Commercial Rent is a civil law procedure that does not require the
involvement of any court proceedings and bailiffs can be instructed the
day after Quarter day if necessary. Exis's approach to this service
is to leave the landlord or their agent in total control of the
situation throughout the entire process. A signed walking possession
agreement will be obtained on the first visit; this secures the
landlord's position against other creditors and allows instalment plans
to be offered whilst remaining in charge of the effects. Goods can also
be removed on the first visit if deemed appropriate and taken into
secure storage, either instruction puts the landlord in the driving seat
in the recovery of their outstanding indebtedness.
A dedicated client
team will monitor payment arrangements and provide daily up dates as to
the progress of the recovery action. In 99% of instructions the
landlord receives full payment of the outstanding rent whilst
maintaining the landlord/tenant relationship. Cleared funds are
remitted within 24 hours and remittances can be made via electronic or
hard format depending on the client's wish. A full breakdown of all
costs raised will accompany each remittance in order to maintain a
transparent audit trail. Exiswill only use directly employed,
certificated staff to provide enforcement recovery and our focus is to
support and advise the clients at all times, so that they are capable of
making informed judgements.
Another alternative to
distraint action is peaceable forfeiture and re-entry; once again there
is no requirement for the landlord to seek leave of the Court to carry
out this action. Instructions to re-enter can be given any time
after the nominated period within the lease agreement. This is
usually 21 or 28 days after the quarter day depending on the terms of
the lease.
Instructions can be
given electronically by completing our on-line possession order or in
hard format; instructions will be carried out within 24 hours of being
received. Exiswill use trained agents for this work who are
accompanied by skilled locksmiths that are fully insured. The re-entry
will be conducted outside of the operating hours of the business and
whilst on site, bailiffs will complete an inventory of the goods for the
landlord's information and security. The inventory will be digitally
recorded and then e-mailed to the client in cases of pound breach or for
valuation purposes.
Our staff can be
employed to oversee the removal of the goods by the tenant; this
maintains the landlord's position and prevents any attempts by the
tenant of regaining entry. The premises will be left secured at all
times and the keys forwarded to the client or their agent.
